Due to the outbreak of the new crown epidemic, the supply of protective equipment such as masks is in short supply. On January 21, 2020, the defendant Li Dong contacted the cousin defendant Li Yuzhang who worked in Sinopharm Shanxi Co., Ltd. and asked him to find a channel to buy masks. Li Yuzhang found Yimou, a seller in Gaomi, Shandong province through Taobao (a separate case was handled), and Yimou provided Li Yuzhang with a quality inspection report through WeChat. After Li Yuzhang reported the relevant situation to Li Dong, Li Dong agreed to purchase and authorized Li Yuzhang to be responsible for price negotiation and delivery.

In the early morning of January 22, Li Yuzhang and Luo Hanyi drove from Shanxi to Gaomi, Shandong. After the two arrived at Gaomi, they met Yimou on the side of the street. During the negotiation of the price, they asked the other party to charge one more yuan for each mask as a rebate.

From January 24, 2020, buyers and customers of Kangbaixin's franchised stores have reported that the quality of masks is problematic. On January 26, the Chaoyang District Market Supervision Administration obtained 636 masks from a franchise store; on January 27, it received 2530 masks from a franchise store; on January 30, the market supervision department and the public security agency obtained the masks from Li Dongtongzhou’s home. 21,135 masks were removed from the pharmacy. The aforementioned masks are currently being seized.

Fake mask manufacturer was sentenced to 10 months imprisonment

The Beijing Xicheng District Court has imposed penalties on the above-mentioned fake and inferior 3M mask manufacturer in Gaomi City.

According to the China Judgment Document Network, the first-instance criminal verdict published on June 5 shows that the defendant Zhou Qinghong was detained on February 1, 2020 on suspicion of selling goods with counterfeit registered trademarks, and arrested on February 26. The public prosecution agency charged that on January 27, 2020, defendant Zhou Qinghong sold more than 9,000 masks with counterfeit "3M" registered trademarks at a price of 6 to 7 yuan each for personal gain, with a sales amount of 57,689 yuan. On January 31, the victims Liu and Li discovered problems with the purchased masks during harvest inspection and reported them to the case. After inspection, the above-mentioned masks are all counterfeit "3M" registered trademarks and the filtration efficiency data does not meet the requirements of national standards.

In the end, the defendant in Beijing’s Xicheng District Court ruled that Zhou Qinghong was guilty of selling products with counterfeit registered trademarks and sentenced to ten months’ imprisonment and a fine of 10,000 yuan.

According to a report from Gaomi Public Security, on February 3, under the unified command of the Shandong Provincial Public Security Department, the public security organs of Weifang and Gaomi moved quickly to successfully detect the case of Yi Mouyu and others manufacturing and selling counterfeit brand masks.

After investigation, the suspect Yi Mouyu purchased fake and shoddy masks from 4 people including Zhou Mouliang and Zhou Mousan and sold them to Beijing, Shanxi and other places. The public security organs proceeded to investigate and destroyed 3 counterfeit dens, arrested 6 suspects, seized 3,500 counterfeit masks, seized 10 production equipment, 30 rolls of non-woven fabrics, and 10 bags of filter cotton.

On February 11, the Gaomi Public Security Bureau issued the "Notice on Severely Cracking down on Illegal Crimes of Manufacturing and Selling Counterfeit Masks and Other Protective Materials." Behaviors such as medical devices and medical sanitary materials that do not meet the national and industry standards for safeguarding human health shall be severely cracked down.
